1. La sottovoce 22021000 comprende le acque, comprese le acque minerali e le acque gassate, con aggiunta di zucchero o di altri dolcificanti o di aromatizzanti, sempre che esse siano atte al consumo direttamente come tali, in qualità di bevanda.

2. Per l'applicazione delle voci 2204, 2205 e 22060010, secondo il caso, si intende per:

  1. a) titolo alcolometrico volumico effettivo: il numero di parti in volume di alcole puro ad una temperatura di 20 °C, contenute in 100 parti in volume del prodotto considerato a quella temperatura;

  2. b) titolo alcolometrico volumico potenziale: il numero di parti in volume di alcole puro ad una temperatura di 20 °C, che possono essere prodotte alla fermentazione totale degli zuccheri contenuti in 100 parti in volume del prodotto considerato a quella temperatura;

  3. c) titolo alcolometrico volumico totale: la somma dei titoli alcolometrici volumici effettivi e potenziali;

  4. d) titolo alcolometrico volumico naturale: il titolo alcolometrico volumico totale del prodotto considerato prima di qualsiasi arricchimento;

  5. e) % vol: il simbolo che rappresenta il titolo alcolometrico volumico.

3. Per l'applicazione della sottovoce 22043010, si considera come mosto di uva parzialmente fermentato, il prodotto proveniente dalla fermentazione di mosto di uva e avente un titolo alcolometrico volumico effettivo superiore a 1 % vol e inferiore ai tre quinti del suo titolo alcolometrico volumico totale.

4. Per l'applicazione delle sottovoci 220421, 220422 e 220429:

  1. A. Si intende per «estratto secco totale», il tenore in grammi per litro di tutte le sostanze presenti nel prodotto che non si volatilizzano in condizioni fisiche determinate.

    La determinazione dell'estratto secco totale deve essere effettuata a 20 °C con il metodo densimetrico.

  2. B.

    a) Non ha influenza, ai fini della classificazione, la presenza nei prodotti rientranti nelle sottovoci da 22042111 a 22042198 , 22042222 a 22042298 e da 22042922 a 22042998 delle quantità di estratto secco totale per litro indicate nelle seguenti categorie tariffarie 1, 2, 3 e 4:

    1. 1. prodotti con titolo alcolometrico volumico effettivo di 13 % vol o meno: 90 g o meno di estratto secco totale per litro;

    2. 2. prodotti con titolo alcolometrico volumico effettivo superiore a 13 % vol e non superiore a 15 % vol: 130 g o meno di estratto secco totale per litro;

    3. 3. prodotti con titolo alcolometrico volumico effettivo superiore a 15 % vol e non superiore a 18 % vol: 130 g o meno di estratto secco totale per litro;

    4. 4. prodotti con titolo alcolometrico volumico effettivo superiore a 18 % vol e non superiore a 22 % vol: 330 g o meno di estratto secco totale per litro.

    I prodotti contenenti un estratto secco totale superiore al massimo fissato qui sopra per ogni categoria sono da classificare nella prima categoria seguente, fermo restando che se l'estratto secco totale supera i 330 g per litro, i prodotti stessi debbono rientrare nelle sottovoci 22042198 , 22042298 e 22042998;

    b) le norme precedenti non si applicano ai prodotti previsti nelle sottovoci 22042123 e 22042233.

5. Le sottovoci da 22042111 a 22042198, 22042222 a 22042298 e da 22042922 a 22042998 comprendono in particolare:

  1. a) il mosto di uve fresche mutizzato con alcole, cioè il prodotto:

    • avente un titolo alcolometrico volumico effettivo uguale o superiore a 12 % vol e inferiore a 15 % vol, e

    • ottenuto mediante aggiunta di un prodotto proveniente dalla distillazione del vino ad un mosto di uve non fermentato avente un titolo alcolometrico volumico naturale non inferiore a 8,5 % vol;

  2. b) il vino alcolizzato, cioè il prodotto:

    • avente un titolo alcolometrico volumico effettivo non inferiore a 18 % vol e non superiore a 24 % vol,

    • ottenuto esclusivamente mediante aggiunta di un prodotto non rettificato, proveniente dalla distillazione di vino e avente un titolo alcolometrico volumico effettivo massimo di 86 % vol, a un vino non contenente zucchero residuo, e

    • avente un'acidità volatile massima espressa in acido acetico di 1,50 g/l;

  3. c) il vino liquoroso, cioè il prodotto:

    • avente un titolo alcolometrico volumico totale non inferiore a 17,5 % vol e un titolo alcolometrico volumico effettivo non inferiore a 15 % vol e non superiore a 22 % vol, e

    • ottenuto da mosto di uve da vino, purché tali prodotti provengano da vitigni ammessi nel paese terzo di origine per la produzione di vino liquoroso ed abbiano un titolo alcolometrico volumico naturale non inferiore a 12 % vol:

      • mediante concentrazione a freddo, o

      • mediante aggiunta, durante o dopo la fermentazione:

        • di un prodotto proveniente dalla distillazione del vino, o

        • di mosto di uve concentrato o, per taluni vini liquorosi a denominazione di origine o a indicazione geografica compresi nell'elenco di cui al regolamento delegato (UE) 2019/934 della Commissione (GU L 149 dell'7.6.2019, pag. 1) e per i quali tale pratica è tradizionale, di mosto di uve concentrato al fuoco diretto e che, eccezion fatta per questa operazione, risponda alla definizione del mosto di uve concentrato, o

        • di una miscela di tali prodotti.

    Tuttavia taluni vini liquorosi a denominazione di origine o a indicazione geografica compresi nell'elenco di cui al regolamento delegato (UE) 2019/934 possono essere ottenuti da mosto di uve fresche non fermentato che non deve necessariamente avere un titolo alcolometrico volumico naturale minimo di 12 % vol.

6. Per l'applicazione delle sottovoci 220410, 220421, 220422 e 220429:

  1. a) si considerano come «vini a denominazione di origine protetta (DOP)» e «vini a indicazione geografica protetta (IGP)» i vini conformi alle disposizioni di cui ai articoli da 93 a 108 del Regolamento (UE) n. 1308/2013 del Parlamento europeo e del Consiglio (GU L 347 dell'20.12.2013, pag. 671), nonché alle disposizioni adottate in applicazione di tale Regolamento e definite dalle regolamentazioni nazionali;

  2. b) si considerano come «vini varietali» i vini conformi alle disposizioni di cui all'articolo 120 del Regolamento (UE) n. 1308/2013 del Parlamento europeo e del Consiglio, nonché alle disposizioni adottate in applicazione di tale Regolamento e definite dalle regolamentazioni nazionali;

  3. c) si considerano come "vini prodotti nell'Unione europea" i vini conformi alle disposizioni del regolamento (UE) n. 1308/2013 del Parlamento europeo e del Consiglio, nonché alle disposizioni dell'articolo 45 del regolamento delegato (UE) 2019/33 della Commissione che integra il regolamento (UE) n. 1308/2013 del Parlamento europeo e del Consiglio.

7. Ai fini delle sottovoci 22043092 e 22043096, per «mosto di uve concentrato» si intende il mosto di uve la cui lettura a 20 °C al rifrattometro, utilizzato secondo il metodo prescritto nella «Raccolta dei metodi internazionali d'analisi dei vini e dei mosti» dell'Organizzazione internazionale della vigna e del vino, riportato nella Gazzetta ufficiale, serie «C», è uguale o superiore a 50,9 %.

8. Sono considerati prodotti della voce 2205 unicamente i vermut e gli altri vini di uve fresche preparati con piante o con sostanze aromatiche aventi un titolo alcolometrico effettivo uguale o superiore a 7 % vol.

9. Per l'applicazione della sottovoce 22060010, si considera come «vinello» il prodotto ottenuto dalla fermentazione delle vinacce vergini macerate nell'acqua o mediante esaurimento con acqua delle vinacce fermentate.

10. Per l'applicazione delle sottovoci 22060031 e 22060039, si considerano come spumanti:

  • le bevande fermentate presentate in bottiglie chiuse con un tappo a «forma di fungo» tenuto da fermagli o da legacci,

  • le bevande fermentate altrimenti presentate ed aventi una sovrappressione uguale o superiore a 3 bar misurata a 20 °C.

11. Per l'applicazione delle sottovoci 22090011 e 22090019, si considera come «aceto di vino» l'aceto ottenuto esclusivamente dalla fermentazione acetica del vino e avente un tenore in acidità totale espressa, in acido acetico, uguale o superiore a 60 g/l.

12. La sottovoce 220720 comprende miscele di alcole etilico utilizzato come materia prima per la produzione di carburanti per autoveicoli con titolo alcolometrico volumico uguale o superiore a 50 % vol e denaturate con una o più delle seguenti sostanze:

  1. a) benzina per autoveicoli (conforme alla norma EN 228);

  2. b) ossido di terz-butile e etile (ossido di etile e terz-butile, ETBE);

  3. c) osside di terz-butile e metile (MTBE);

  4. d) 2-metilpropan-2-olo (alcol terz-butilico, terziar-butil alcol, TBA);

  5. e) 2-metilpropan-1-olo (2-metil-1-propanolo, isobutanolo);

  6. f) propan-2-olo (alcol isopropilico, 2-propanolo, isopropanolo).

I denaturanti di cui alle lettere e) e f) del primo comma devono essere utilizzati in combinazione con almeno uno dei denaturanti elencati alle lettere da a) a d) del primo comma.

13. Ai sensi delle sottovoci 22029911 e 22029915, il contenuto proteico è determinato moltiplicando il contenuto di azoto totale, calcolato utilizzando il metodo di cui all'allegato III, parte C, punti da 2 a 8 del Regolamento (CE) n. 152/2009 della Commissione, per il fattore 6,25.
