The prohibition shall not apply in respect of:
(a) the execution until 26 September 2014, of trade contracts concluded before 25 June 2014, or of ancillary contracts necessary for the execution of such contracts, provided that the natural or legal persons, entity or body seeking to perform the contract have notified, at least 10 working days in advance, the activity or transaction to the competent authority of the Member State in which they are established.
(b) goods originating in Crimea or Sevastopol which have been made available to the Ukrainian authorities for examination, for which compliance with the conditions conferring entitlement to preferential origin has been verified and for which a certificate of origin has been issued in accordance with Regulation (EU) No 978/2012 and Regulation (EU) No 374/2014, as retained in UK Law, or in accordance with the EU-Ukraine Association Agreement

When related to the use in Crimea or Sevastopol, the prohibitions do not apply where there are no reasonable grounds to determine that the goods and technology or the services are to be used in Crimea or Sevastopol.

A) Som »certificerede referencematerialer« (pos. 3822) anses referencematerialer, som er ledsaget af et certifikat, der viser værdien af de certificerede egenskaber, de anvendte metoder til fastsættelse af værdien og usikkerheden for hver værdi, og som er egnet til analyse-, kalibrerings- eller referenceformål.
B) Ved tariferingen af certificerede referencematerialer, undtagen produkter henhørende under kapitel 28 eller 29, skal pos. 3822 anvendes frem for enhver anden position i nomenklaturen.
3. Følgende varer henføres til pos. 3824 og ikke til nogen anden position i nomenklaturen:
a) kunstigt fremstillede krystaller (bortset fra optiske artikler) af magnesiumoxid eller af halogenider af alkalimetaller eller alkaliske jordarters metaller, af vægt 2,5 g eller derover pr. stk.
b) fuselolie; dippelsolie
c) blækfjerningsmidler i pakninger til detailsalg
d) korrekturlak og andre korrektionsvæsker samt rettetape (undtagen varer henhørende under pos. 9612), i pakninger til detailsalg
e) smeltelige artikler til temperaturkontrol i brændingsovne (fx segerkegler).
4. Som »kommunalt affald« forstås overalt i nomenklaturen affald af den art, der indsamles fra private husholdninger, hoteller, restauranter, hospitaler, butikker, kontorer osv., og opfejning fra gader og veje samt affald fra bygge- og nedrivningsarbejder. Kommunalt affald består almindeligvis af mange forskellige materialer såsom plast, gummi, træ, papir, tekstil, glas, metaller, næringsmidler, itugåede møbler og andre ødelagte eller kasserede varer. Betegnelsen »kommunalt affald« omfatter ikke:
a) individuelle materialer eller varer udskilt fra affald, såsom affald af plast, gummi, træ, papir, tekstil, glas eller metaller, affald og skrot af elektrisk og elektronisk udstyr (herunder brugte batterier), som tariferes i de respektive positioner for sådanne varer;

5. Som »kloakslam« (pos. 3825) anses slam hidrørende fra offentlige rensningsanlæg og omfatter forbehandlet affald, frasigtet affald og ikke-stabiliseret slam. Stabiliseret slam, der er egnet til anvendelse som gødning, er undtaget (kapitel 31).
6. Som »andet affald« (pos. 3825) anses:
a) klinisk affald, dvs. forurenet affald fra medicinsk forskning, diagnose, behandling eller anden medicinsk, kirurgisk, dental eller veterinær procedure, ofte indeholdende patogene eller farmaceutiske stoffer, som kræver specielle håndteringsprocedurer (fx snavsede beklædningsgenstande, brugte handsker, brugte sprøjter)
b) organiske opløsningsmidler i form af affald
c) affald i form af væsker fra metalbejdsning, hydrauliske væsker, bremsevæsker og antifrostpræparater
d) andet affald fra kemiske og nærstående industrier.
Udtrykket »andet affald« omfatter imidlertid ikke affald, der hovedsagelig består af jordolier eller af olier hidrørende fra bituminøse mineraler (pos. 2710).
7. Som »biodiesel« (pos. 3826) betragtes fedtsyremonoalkylestere fremstillet af animalske, vegetabilske eller mikrobielle fedtstoffer og olier, også brugt, af den art der anvendes som brændstof.
