The prohibition shall not apply in respect of:

A. U smislu tarifnog broja 3822, pod pojmom „certificirani referentni materijali” podrazumijeva se referentne materijale koje prati certifikat s iskazanim certificiranim (potvrđenim) vrijednostima, metodama korištenim da bi se ove vrijednosti utvrdile i stupnjem sigurnosti vezanim uz svaku pojedinu vrijednost, prikladne za analitičke namjene, kalibriranje ili referentne svrhe.
B. S izuzetkom proizvoda iz poglavlja 28 ili 29, za razvrstavanje certificiranih referentnih materijala, tarifni broj 3822 ima prednost u odnosu na sve ostale tarifne brojeve nazivlja.
3. U tarifni se broj 3824, a ne u druge tarifne brojeve nomenklature, razvrstava sljedeću robu:
a) kultivirane kristale (osim optičkih elemenata) pojedinačne mase ne manje od 2,5 g, od magnezijevog oksida ili od halida alkalijskih ili zemno-alkalijskih kovina;
b) fuzelno ulje; dippelovo ulje;
c) pripravke za brisanje tinte, pripremljene u pakiranja za pojedinačnu prodaju;
d) korektore za matrice i ostale korekturne tekućine i korekturne trake (osim onih iz tarifnog broja 9612), pripremljene u pakiranjima za pojedinačnu prodaju; i
e) taljive keramičke mjerače temperature u pećima (na primjer, Segerove stošce).
4. U cijelom se nazivlju, pod pojmom „gradski otpad” podrazumijeva otpad vrsta koje se prikuplja iz kućanstva, hotela, restorana, bolnica, prodavaonica, ureda itd., otpad nastao pri uređenju i asfaltiranju putova, kao i otpad nastao izgradnjom ili rušenjem građevina. Gradski otpad općenito sadrži različite vrste materijala kao što su plastične mase, guma, drvo, papir, tekstil, staklo, kovine, prehrambene proizvode, odbačeno pokućstvo i druge oštećene ili odbačene proizvode. Međutim, pojam „gradski otpad” ne uključuje:
a) pojedinačne materijale ili proizvode izdvojene iz otpada, kao što su plastika, guma, drvo, papir, tekstil, staklo ili kovine, električni i elektronički otpad i ostaci (uključujući istrošene baterije), koje se razvrstava u odgovarajuće tarifne brojeve nomenklature;
b) industrijski otpad;
c) otpadne farmaceutske proizvode definirane napomenom 4 (k) uz poglavlje 30; ili
d) klinički otpad definiran sljedećom napomenom 6 (a).
5. U smislu tarifnog broja 3825, pod pojmom „kanalizacijski mulj” podrazumijeva se mulj (talog) koji nastaje u postrojenjima za obradu gradskih otpadnih voda, a uključuje predobrađeni otpad ove vrste, izmet i nestabilizirani mulj. Stabilizirani se mulj, ako je prikladan za uporabu kao gnojivo, isključuje (poglavlje 31).
6. U smislu tarifnog broja 3825, pod pojmom „ostali otpadi” podrazumijeva se:
a) klinički otpad, odnosno zagađeni otpad što nastaje prilikom medicinskih istraživanja, dijagnostike, liječenja ili drugih medicinskih, kirurških, zubarskih ili veterinarskih postupaka, a često sadrži patogene i farmaceutske tvari što zahtijeva posebne postupke odlaganja (na primjer, onečišćene odore, rabljene rukavice, rabljene igle za injekcije);
b) otpadna organska otapala;
c) otpadne tekućine od obrade kovina, hidraulične tekućine, kočione tekućine, tekućine protiv smrzavanja; i
d) ostali otpadi iz kemijske industrije ili srodnih industrija.
Međutim, pod pojmom „ostali otpadi” ne podrazumijeva se otpade koji sadrže uglavnom naftna ulja ili ulja dobivena od bitumenskih minerala (tarifni broj 2710).
7. Za potrebe tarifnog broja 3826, pod pojmom „biodizel” podrazumijevaju se monoalkilni esteri masnih kiselina vrsta koje se rabi kao gorivo, dobiveni od životinjskih, mikrobnih ili biljnih masti i ulja neovisno jesu li rabljeni ili ne.

1.
