EAPA investigation

Also called: Enforce and Protect Act · evasion investigation

An investigation by CBP under the Enforce and Protect Act of 2015 into whether an importer evaded anti-dumping or countervailing duties, for example through transshipment, undervaluation or misdescription. CBP can impose interim measures, such as suspending liquidation and requiring cash deposits, while the case runs.

In practice

An EAPA allegation can freeze an importer's entries quickly, so supply-chain documentation proving true origin should be ready before problems arise.
