  2. b) «titre alcoométrique volumique en puissance» : le nombre de volumes d'alcool pur à une température de 20 °C susceptibles d'être produits par fermentation totale des sucres contenus dans 100 volumes du produit considéré à cette température;

4. Pour l'application des sous-positions 220421, 220422 et 220429:

  1. A. on entend par «extrait sec total» la teneur en grammes par litre de toutes les substances présentes dans le produit qui, dans des conditions physiques déterminées, ne se volatilisent pas.

    La détermination de l'extrait sec total doit être effectuée à 20 degrés Celsius par la méthode densimétrique;

  2. B.

    a) la présence dans les produits relevant des sous-positions 22042111 à 22042198 et 22042222 à 22042298 et 22042922 à 22042998 des quantités d'extrait sec total par litre indiquées dans les catégories tarifaires 1, 2, 3 et 4 visées ci-dessous est sans influence sur leur classement:

    1. 1) produits ayant un titre alcoométrique volumique acquis de 13 % vol ou moins: 90 grammes ou moins d'extrait sec total par litre;

    2. 2) produits ayant un titre alcoométrique volumique acquis de plus de 13 % vol et pas plus de 15 % vol: 130 grammes ou moins d'extrait sec total par litre;

    3. 3) produits ayant un titre alcoométrique volumique acquis de plus de 15 % vol et pas plus de 18 % vol: 130 grammes ou moins d'extrait sec total par litre;

    4. 4) produits ayant un titre alcoométrique volumique acquis de plus de 18 % vol et pas plus de 22 % vol: 330 grammes ou moins d'extrait sec total par litre.

    Les produits présentant un extrait sec total dépassant le maximum fixé ci-dessus dans chaque catégorie doivent être classés dans la première catégorie suivante, étant entendu que, si l'extrait sec total dépasse 330 grammes par litre, les produits doivent être classés dans les sous-positions 22042198, 22042298 et 22042998;

    b) les règles visées ci-dessus ne sont pas applicables aux produits repris aux sous-positions 22042123 et 22042233.

5. Les sous-positions 22042111 à 22042198, 22042222 à 22042298 et 22042922 à 22042998 comprennent notamment:

  1. a) le moût de raisin frais muté à l'alcool, c'est-à-dire le produit:

    • ayant un titre alcoométrique volumique acquis égal ou supérieur à 12 % vol et inférieur à 15 % vol, et

    • obtenu par addition d'un produit provenant de la distillation du vin à un moût de raisin non fermenté ayant un titre alcoométrique naturel non inférieur à 8,5 % vol;

  2. b) le vin viné, c'est-à-dire le produit:

    • ayant un titre alcoométrique volumique acquis non inférieur à 18 % vol et non supérieur à 24 % vol,

    • obtenu exclusivement par adjonction d'un produit non rectifié provenant de la distillation du vin et ayant un titre alcoométrique acquis maximal de 86 % vol, à un vin ne contenant pas de sucre résiduel, et

    • ayant une acidité volatile maximale de 1,50 gramme par litre, exprimée en acide acétique;

  3. c) le vin de liqueur, c'est-à-dire le produit:

    • ayant un titre alcoométrique volumique total non inférieur à 17,5 % vol ainsi qu'un titre alcoométrique volumique acquis non inférieur à 15 % vol et non supérieur à 22 % vol, et

    • obtenu à partir de moût de raisin ou de vin, ces produits devant être issus de cépages admis dans le pays tiers d'origine pour la production de vin de liqueur et ayant un titre alcoométrique naturel non inférieur à 12 % vol:

      • par congélation, ou

      • par addition, pendant ou après fermentation:

        • soit d'un produit provenant de la distillation du vin,

        • soit de moût de raisins concentré ou, pour certains vins de liqueur avec appellation d’origine ou indication géographique figurant sur la liste établie dans le règlement délégué (UE) 2019/934 de la Commission (JO L 149 du 7.6.2019, p. 1) et pour lesquels une telle pratique est traditionnelle, de moût de raisins dont la concentration a été effectuée par l’action du feu direct et qui répond, à l’exception de cette opération, à la définition du moût de raisins concentré, ou

        • soit d'un mélange de ces produits.

    Toutefois, certains vins de liqueur avec appellation d’origine ou indication géographique figurant sur la liste établie dans le règlement délégué (UE) 2019/934 peuvent être obtenus à partir de moût de raisins frais, non fermenté, sans que ce dernier doive avoir un titre alcoométrique naturel minimal de 12 % vol.

6. Pour l'application des sous-positions 220410, 220421, 220422 et 220429:

  1. a) sont considérés comme «vins avec appellation d'origine protégée (AOP)» et «vins avec indication géographique protégée (IGP)» les vins répondant aux prescriptions des articles 93 à 108, du règlement (UE) no 1308/2013 du Parlement européen et du Conseil (JO L 347 du 20.12.2013, p. 671) ainsi qu'à celles arrêtées en application dudit règlement et définies par les réglementations nationales;

  2. b) sont considérés comme «vins de cépages» les vins répondant aux prescriptions de l'article 120, du règlement (UE) no 1308/2013 du Parlement européen et du Conseil ainsi qu'à celles arrêtées en application dudit règlement et définies par les réglementations nationales;

  3. c) sont considérés comme «vins produits dans l’Union européenne» les vins répondant aux prescriptions du règlement (UE) no 1308/2013 du Parlement européen et du Conseil et de l’article 45 du règlement délégué (UE) 2019/33 de la Commission complétant le règlement (UE) no 1308/2013 du Parlement européen et du Conseil.

7. Pour l'application des sous-positions 22043092 et 22043096, est considéré comme «moût de raisins concentré» le moût de raisins dont l'indication chiffrée fournie à la température de 20 degrés Celsius par le réfractomètre (utilisé selon la méthode prévue au «Recueil des méthodes internationales d'analyse des vins et des moûts» de l'Organisation internationale de la vigne et du vin, publié au Journal officiel, série C) est égale ou supérieure à 50,9 %.

8. Sont considérés comme des produits relevant du no 2205 seulement les vermouths et autres vins de raisins frais préparés à l'aide de plantes ou de substances aromatiques dont le titre alcoométrique volumique acquis est égal ou supérieur à 7 % vol.

9. Pour l'application de la sous-position 22060010, on considère comme «piquette» le produit obtenu par la fermentation des marcs de raisins vierges macérés dans l'eau ou par épuisement avec de l'eau des marcs de raisins fermentés.

10. Pour l'application des sous-positions 22060031 et 22060039, on considère comme «mousseuses»:

  • les boissons fermentées présentées dans des bouteilles fermées par un bouchon «champignon» maintenu à l'aide d'attaches ou de liens,

  • les boissons fermentées, autrement présentées, ayant une surpression égale ou supérieure à 3 bars, mesurée à la température de 20 °C.

11. Pour l'application des sous-positions 22090011 et 22090019, on considère comme «vinaigre de vin» le vinaigre obtenu exclusivement par fermentation acétique du vin et ayant une teneur en acidité totale égale ou supérieure à 60 grammes par litre, exprimée en acide acétique.

12. Relèvent de la sous-position 220720 les mélanges d'alcool éthylique utilisés comme matière première pour la production de carburants pour les véhicules à moteur d'un titre alcoométrique volumique de 50 % ou plus et dénaturés au moyen d'une ou de plusieurs des substances suivantes:

  1. a) essence automobile (conforme à la norme EN 228);

  2. b) oxyde de tert-butyle et d'éthyle (oxyde d'éthyle et de tert-butyle, ETBE);

  3. c) oxyde de tert-butyle et de méthyle (MTBE);

  4. d) 2-méthylpropane-2-ol (alcool tert-butylique, tert-butanol, TBA);

  5. e) 2-méthylpropane-1-ol (2-méthylpropane-1, isobutanol);

  6. f) propane-2-ol (alcool isopropylique, 2-propanol, isopropanol).

Les dénaturants visés aux points e) et f) du premier alinéa doivent être utilisés en combinaison avec au moins un des dénaturants énumérés aux points a) à d) du premier alinéa.

13. Aux fins des sous-positions 22029911 et 22029915, la teneur en protéines est déterminée en multipliant la teneur en azote totale, calculée selon la méthode prévue aux points 2 à 8 de la partie C de l'annexe III du règlement (CE) no 152/2009 de la Commission, par le facteur 6,25.
