(m) monopods, bipods, tripods and similar articles (heading 9620).
2. The articles (other than parts) referred to in headings 9401 to 9403 are to be classified in those headings only if they are designed for placing on the floor or ground.
The following are, however, to be classified in the headings mentioned above, even if they are designed to be hung, to be fixed to the wall or to stand one on the other:
(a) cupboards, bookcases, other shelved furniture (including single shelves presented with supports for fixing them to the wall) and unit furniture;
(b) seats and beds.
3.
(A) In headings 9401 to 9403 references to parts of goods do not include references to sheets or slabs (whether or not cut to shape but not combined with other parts) of glass (including mirrors), marble or other stone or of any other material referred to in Chapter 68 or 69.
(B) Goods described in heading 9404, presented separately, are not to be classified in heading 9401, 9402 or 9403 as parts of goods.
4. For the purposes of heading 9406, the expression ‘prefabricated buildings’ means buildings which are finished in the factory or put up as elements, presented together, to be assembled on site, such as housing or worksite accommodation, offices, schools, shops, sheds, garages or similar buildings.
Prefabricated buildings include ‘modular building units’ of steel, normally presented in the size and shape of a standard shipping container, but substantially or completely pre-fitted internally. Such modular building units are normally designed to be assembled together to form permanent buildings.
The European Commission's explanatory notes on how to classify goods in these CN codes. They are not legally binding but customs authorities follow them; they complement the HS Explanatory Notes of the World Customs Organization.
9401 · Seats (other than those of heading 9402), whether or not convertible into beds, and parts thereof
This heading includes sets of a table and chairs, where the table is designed for other purposes than dining while sitting on the seats (chairs, stools, deck-chairs, armchairs, couches etc.). Generally, these tables are too small for dining and they are inferior to the seats e.g. in size. Consequently, the seats give the set its essential character within the meaning of GIR 3(b). (See also the CN Explanatory Notes to heading 9403).
Examples of sets falling under heading 9401:
For the purposes of this heading, any reference to bamboo applies only to vegetable materials of heading 1401. On the other hand, for the purposes of this heading, any reference to wood or wooden applies also to bamboo plates of heading 4412. (See also note 1(b) and note 6 to Chapter 44).
General notes to the chapter
FURNITURE; BEDDING, MATTRESSES, MATTRESS SUPPORTS, CUSHIONS AND SIMILAR STUFFED FURNISHINGS; LAMPS AND LIGHTING FITTINGS, NOT ELSEWHERE SPECIFIED OR INCLUDED; ILLUMINATED SIGNS, ILLUMINATED NAMEPLATES AND THE LIKE; PREFABRICATED BUILDINGS
General
For the purposes of this Chapter the term ‘furniture’ implies that these products are generally designed to remain in private dwellings or gardens etc. See also the definition of the term ‘furniture’ in the HS Explanatory Note to Chapter 94, General, second paragraph, (A).
Consequently, inflatable articles (such as inflatable chairs, inflatable lounge chairs etc.) that are generally designed to be taken along to different places (for example, camping grounds, the beach, etc.) and to be used there temporarily are not furniture within the meaning of Chapter 94, but depending on their constituent material are camping goods of heading 6306 or articles of Chapters 39 or 40.
Due to their objective characteristics these inflatable articles are easy to transport, because they are lightweight, easy and quick to set-up and to pack away.
