Last substantial transformation
Also called: substantial transformation · son esaslı işlem
The core test of non-preferential origin. In the EU (UCC Article 60), goods involving more than one country originate where they underwent their last substantial, economically justified processing that resulted in a new product or an important stage of manufacture. US courts and CBP ask whether processing created a new article with a different name, character or use.
In practice
Assembly in a third country to avoid duties on a particular origin is tested against this rule, and minor assembly rarely succeeds.
